Article 12. Regulations on vehicle journey monitoring devices
1. Passenger transport vehicles, freight transport vehicles and shuttle vehicles must be equipped with journey monitoring devices.
2. Vehicle journey monitoring devices must comply with national technical regulations and ensure good technical condition, operating continuously during the time the vehicle is in traffic.
3. Vehicle journey monitoring devices must ensure at least the following requirements:
a) Store and transmit information including: Journey, operating speed, continuous driving time to the journey monitoring data system of the Ministry of Transport (Vietnam Road Administration);
b) Information from the vehicle journey monitoring device is used in state management of transport activities, management of transport business units' activities and is connected and shared with the Ministry of Public Security (Traffic Police Department), Ministry of Finance (General Department of Taxation) to carry out state management of traffic order and safety; security, order; tax.
4. Vietnam Road Administration stores data on vehicle violations for 03 years.
5. Transport business units shall maintain the operation of the journey monitoring device to ensure the provision of information as prescribed in Point a, Clause 3 of this Article.
6. Transport business units and transport business drivers are not allowed to use technical measures, peripheral equipment, or other measures to interfere with the operation, disrupt (or interfere with) GPS, GSM waves, or distort data of the vehicle's journey monitoring device. Before driving a vehicle, the driver must use his driver identification card to log in information through the card reader of the vehicle's journey monitoring device and log out when driving is finished to serve as a basis for determining continuous driving time and working time during the day.
