According to the definition stated by the Ministry of Public Security, a journey monitoring device is an electronic device mounted directly on a car with the function of transmitting information identifying the vehicle's route, speed, driver information, information on the number of times and parking time of the vehicle to the server during the vehicle's operation.
There are two types of journey monitoring devices, including journey monitoring devices without images and journey monitoring devices with integrated cameras.
Meanwhile, the driver image recording device is an electronic device mounted directly inside the car's cockpit to record videos, images, and sounds related to the driver and transmit them to the server during the vehicle's operation.
The Ministry of Public Security proposes to stipulate that data from the journey monitoring device and driver image data must be transmitted to the service server at a frequency of no more than 30 seconds at a time when the vehicle is running and no more than 15 minutes at a time when the vehicle is idle (when the vehicle stops, parks to rest on the journey, or waits to pick up passengers at bus stations for fixed routes).
Data from the journey monitoring device and driver image data from the service server must be transmitted to the server of the Traffic Police Department of the Ministry of Public Security) within no more than 2 minutes from the time the service server receives the data.
At the same time, data from the journey monitoring device and driver image data transmitted through the service server to the Traffic Police Department's server must be in chronological order.
In case the transmission line is interrupted, it is allowed to send both old and current data simultaneously when the transmission line is operating normally.
How are violations of speed, driving time, etc. determined?
The draft circular of the Ministry of Public Security also specifically stipulates the method of determining violations related to transportation business activities.
In particular, violations of vehicle speed, continuous driving time, driver working time during the day, and data transmission violations are calculated and determined according to a unified method on the service server and the Traffic Police Department's server.
For speeding violations, the software on the server must calculate the speed of the violation according to the speed limit based on the sign or speed limit area to serve the monitoring and handling of violations according to regulations.
For continuous driving time violations, the software on the server must calculate the continuous driving time, the rest stop time between 2 continuous driving times, the driving time during the day and the driving time during the week of the driver of the car for transport business and internal transport according to regulations to serve the monitoring and handling of violations.
For violations of not transmitting data, this behavior is determined when the vehicle has a position shift compared to the position recorded at the time of stopping data transmission and there is no data during the time the vehicle moves between 2 locations.
